This Privacy Policy explains how Junction Cloud Connections, Inc. d/b/a Voxutel ("Voxutel," "Company," "we," "us," or "our") collects, uses, discloses, and protects information when you visit our websites, create or use a Voxutel account, communicate with us, or purchase or use our telecommunications, messaging, and related services (collectively, the "Services").

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

The information we collect depends upon how you interact with Voxutel and the Services you use.

Account and Contact Information

We may collect information such as:

  • company or organization name;

  • billing address;
  • email address;
  • telephone number;

  • authorized users; and
  • other information provided when creating or managing an account.

Identity and Verification Information

We may collect information reasonably necessary to verify a Customer's identity, business, payment method, or eligibility to use certain Services.

This may include:

  • business registration information;
  • tax identification information;
  • resale or exemption certificates;
  • governmental identification where appropriate;
  • ownership or authorized representative information;
  • fraud-prevention information;
  • IP addresses; and
  • other verification information.

Billing and Payment Information

We may collect information relating to payments and billing, including:

  • billing contact information;
  • transaction history;
  • payment status;
  • account balances;
  • payment method information;
  • credit information;
  • chargeback information; and
  • ACH or credit-card transaction information.

Payment-card and banking information may be processed or stored by third-party payment processors rather than directly by Voxutel.

Telecommunications and Usage Information

In connection with providing telecommunications Services, we may collect and process information including:

  • originating telephone numbers;
  • destination telephone numbers;
  • call dates and times;
  • call duration;
  • call routing information;
  • SIP signaling information;
  • IP addresses;
  • trunk and endpoint information;
  • call disposition;
  • carrier information;
  • billing records;
  • Call Detail Records ("CDRs");
  • number-porting information;
  • CNAM information;
  • E911 provisioning information;
  • emergency service addresses;
  • messaging routing information; and
  • other technical and usage information necessary to provide the Services.

Certain telecommunications information may constitute Customer Proprietary Network Information ("CPNI") or otherwise be subject to telecommunications privacy laws.

Voxutel handles such information in accordance with applicable law.

Messaging Information

When Customer uses SMS or MMS Services, we may process information necessary to transmit, route, troubleshoot, secure, bill, and maintain those Services.

This may include:

  • sending and receiving telephone numbers;
  • message timestamps;
  • delivery information;
  • carrier information;
  • campaign and Brand information;
  • message metadata;
  • delivery receipts; and
  • message content where technically necessary to transmit, troubleshoot, investigate, secure, or comply with applicable law.

E911 Information

If Customer purchases E911 Services, we may collect and process information including:

  • telephone numbers;
  • registered service addresses;
  • dispatchable location information;
  • Customer-provided emergency information; and
  • related provisioning records.

Customer is responsible for ensuring that information submitted for E911 provisioning is accurate and current.

Number Portability Information

When Customer requests telephone-number porting, we may collect and disclose information required to process the request, including:

  • telephone numbers;
  • service addresses;
  • account numbers;
  • billing telephone numbers;
  • authorized names;
  • letters of authorization;
  • current carrier information; and
  • other information required by carriers or numbering administrators.

Website and Technical Information

When you access our website or online portal, we may automatically collect technical information such as:

  • IP address;
  • browser type;
  • operating system;
  • device information;
  • referring pages;
  • pages visited;
  • dates and times of access;
  • session information;
  • login information; and
  • diagnostic and security information.

2. Cookies and Similar Technologies

Voxutel may use cookies, session identifiers, log files, and similar technologies to:

  • operate our website and portal;
  • maintain login sessions;
  • remember preferences;
  • improve functionality;
  • detect abuse;

Certain essential features of our website or Customer portal may not function properly if cookies are disabled.

3. How We Use Information

  • create and administer Customer accounts;
  • provide telecommunications and messaging Services;
  • authenticate users;
  • route calls and messages;
  • assign and manage telephone numbers;
  • process number ports;
  • provision E911;
  • process payments;
  • generate invoices;
  • calculate usage;
  • provide Customer support;
  • troubleshoot Service issues;
  • monitor network performance;
  • prevent fraud;
  • detect unauthorized or prohibited activity;
  • enforce our Terms and Conditions;
  • maintain network and account security;
  • investigate abuse;
  • respond to traceback requests;
  • comply with regulatory obligations;
  • respond to lawful requests;
  • improve our Services;
  • communicate Service and rate changes;
  • send operational and account notices; and
  • protect Voxutel, our Customers, carriers, networks, and the public.

4. Customer Proprietary Network Information

Certain information relating to Customer's telecommunications usage may constitute Customer Proprietary Network Information ("CPNI") under applicable United States telecommunications law.

CPNI may include information relating to a Customer's:

  • telecommunications usage;
  • quantity of Services;
  • technical configuration;
  • type of Services;
  • destination of communications;
  • location information;
  • amount of use; and
  • billing associated with telecommunications Services.

Voxutel will use, disclose, and protect CPNI in accordance with applicable federal law and regulatory requirements.

Voxutel may use CPNI as permitted by law to:

  • provide the telecommunications Service from which the information was derived;
  • provide services necessary to or used in providing such telecommunications Service;
  • protect Voxutel's rights or property;
  • protect users and other carriers from fraudulent, abusive, or unlawful use;
  • provide billing and collection;
  • perform maintenance and troubleshooting;
  • comply with legal and regulatory obligations; and
  • for other purposes authorized by Customer or permitted by law.

5. How We Disclose Information

Voxutel may disclose information when reasonably necessary to provide, operate, secure, support, or bill for the Services.

Underlying Telecommunications Providers

We may disclose information to:

  • underlying carriers;
  • originating carriers;
  • terminating carriers;
  • tandem providers;
  • numbering providers;
  • messaging aggregators;
  • mobile network operators;
  • E911 providers;
  • CNAM providers;
  • STIR/SHAKEN service providers;
  • number-portability providers; and
  • other telecommunications vendors

when reasonably necessary to provide Services.

Service Providers

We may disclose information to vendors providing services on our behalf, including:

  • payment processing;
  • hosting;
  • data-center services;
  • cloud infrastructure;
  • fraud prevention;
  • cybersecurity;
  • billing;
  • analytics;
  • Customer support;
  • email delivery; and
  • professional services.

These providers may receive information only as reasonably necessary to perform services on our behalf or as otherwise permitted by law.

Customer's Authorized Users and Providers

We may disclose account or Service information to persons reasonably believed to be authorized by Customer, including Customer's:

  • administrators;
  • employees;
  • agents;
  • resellers;
  • contractors; and
  • authorized representatives.

Customer is responsible for maintaining appropriate access controls for its account.

Legal and Regulatory Disclosure

We may disclose information when we reasonably believe disclosure is required or permitted by law, including in response to:

  • subpoenas;
  • court orders;
  • warrants;
  • governmental requests;
  • law-enforcement requests;
  • regulatory inquiries;
  • emergency requests;
  • national security requirements;
  • lawful surveillance requirements;
  • traceback requests; or
  • other legal processes.

Fraud, Abuse, and Network Protection

We may disclose relevant information to carriers, industry organizations, regulators, law enforcement, fraud-prevention providers, or other appropriate parties when reasonably necessary to:

  • detect or prevent fraud;
  • investigate illegal robocalls;
  • conduct traceback;
  • investigate spam or abusive messaging;
  • protect telecommunications networks;
  • enforce our Terms;
  • protect the safety of others; or
  • prevent unlawful use of the Services.

Business Transactions

Information may be disclosed or transferred as part of a:

  • merger;
  • acquisition;
  • financing;
  • reorganization;
  • sale of assets;
  • bankruptcy;
  • corporate restructuring; or
  • similar business transaction.

6. Information Provided by Wholesale Customers

Voxutel Customers may provide information concerning their own customers, subscribers, employees, end users, or communications.

Where Customer provides such information to Voxutel, Customer represents that it has the lawful authority to provide that information and to instruct Voxutel to process the information in connection with the Services.

Customer is responsible for:

  • providing legally required privacy notices;
  • obtaining legally required consent;
  • responding to privacy requests from its own end users where applicable;
  • complying with applicable privacy and telecommunications laws; and
  • ensuring that Customer's use of Voxutel Services complies with applicable law.

Voxutel does not assume Customer's independent legal obligations toward Customer's downstream customers or end users.

7. SMS and MMS Privacy

Information collected in connection with SMS and MMS Services may be used to:

  • provide and route messaging Services;
  • register A2P messaging programs;
  • manage TCR Brands and Campaigns;
  • process delivery;
  • prevent spam and fraud;
  • troubleshoot messaging;
  • enforce carrier requirements;
  • investigate complaints;
  • comply with applicable law; and
  • support Customer accounts.

Where Customer provides mobile telephone numbers, consent records, opt-in information, or messaging registration information, Customer is responsible for ensuring that such information was lawfully collected.

Mobile opt-in information and consent obtained for SMS communications will not be sold or provided to third parties for their independent marketing purposes.

Information may nevertheless be disclosed to carriers, messaging providers, aggregators, service providers, and other parties as reasonably necessary to deliver messages, operate the Services, maintain compliance, or as otherwise permitted or required by law.

8. Security

Voxutel uses administrative, technical, and physical safeguards that we consider reasonable and appropriate in light of the nature of the information and Services involved.

However, no Internet transmission, telecommunications network, computer system, storage system, or security measure can be guaranteed to be completely secure.

Customer is responsible for maintaining the security of its own:

  • passwords;
  • SIP credentials;
  • API keys;
  • authentication credentials;
  • PBXs;
  • endpoints;
  • networks; and
  • authorized users.

Customer should notify Voxutel promptly if it believes its account or credentials have been compromised.

9. Data Retention

Voxutel may retain information for as long as reasonably necessary to:

  • provide Services;
  • maintain business and accounting records;
  • process billing;
  • resolve disputes;
  • investigate fraud;
  • maintain network security;
  • comply with telecommunications requirements;
  • satisfy tax and regulatory obligations;
  • respond to legal requests;
  • enforce agreements; and
  • satisfy other legitimate business or legal requirements.

Different categories of information may be retained for different periods.

Information may be retained beyond termination of Customer's account where reasonably necessary or legally required.

10. International Data Processing

Voxutel provides domestic and international telecommunications Services.

Information may therefore be transmitted, routed, processed, or stored in the United States or other countries in connection with the operation of telecommunications networks and the Services.

Data-protection laws may differ between jurisdictions.

Where applicable law imposes specific requirements concerning international transfers or processing of personal information, Voxutel will comply with those requirements to the extent they apply to Voxutel.

Customer is independently responsible for determining and complying with privacy and data-protection laws applicable to Customer's own business, customers, and traffic.

11. International Customers

Customers located outside the United States are responsible for determining whether their use of the Services complies with applicable privacy and data-protection laws in their jurisdiction and in jurisdictions from which or to which they send communications.

Where applicable law grants an individual privacy rights regarding information maintained by Voxutel, requests may be submitted using the contact information below.

Nothing in this Privacy Policy is intended to provide rights beyond those required by applicable law.

12. Privacy Rights

Depending upon your jurisdiction and the nature of your relationship with Voxutel, applicable law may provide rights concerning your personal information, which may include rights to:

  • request access;
  • request correction;
  • request deletion;
  • obtain certain information concerning collection or disclosure;
  • request a copy of certain information;
  • object to or restrict certain processing; or
  • opt out of certain uses or disclosures.

These rights are subject to applicable exceptions and limitations.

  • telecommunications records;

If applicable California privacy law applies to Voxutel's processing of your personal information, California residents may have additional rights concerning their personal information, including rights relating to access, correction, deletion, and certain disclosures or transfers of personal information.

Applicable rights depend upon Voxutel's relationship with the individual, the information involved, statutory thresholds, exemptions, and other circumstances.

Voxutel will not unlawfully discriminate against an individual for exercising rights provided by applicable privacy law.

14. Sale of Personal Information

Voxutel does not sell personal information for monetary consideration as part of its ordinary telecommunications business.

Certain disclosures to telecommunications carriers, vendors, service providers, and other parties are necessary to provide the Services and are not made for the purpose of selling Customer information.

Some privacy laws may define terms such as "sale" or "sharing" more broadly than their ordinary meanings. Where applicable law provides a right to opt out of a qualifying sale or sharing of personal information, Voxutel will honor such rights when required.

15. Children's Privacy

Voxutel Services are not designed or directed primarily toward children under thirteen (13) years of age.

We do not knowingly solicit personal information directly from children under thirteen through our website for the purpose of establishing telecommunications accounts.

If we become aware that personal information has been collected directly from a child in circumstances prohibited by applicable law, we may take reasonable steps to delete or otherwise address the information.

16. Third-Party Websites and Services

Our website or Services may contain links to websites or services operated by third parties.

Voxutel is not responsible for the privacy practices, content, security, or policies of third-party websites or services.

Customers should review the privacy policies of applicable third parties.

17. Do Not Track and Privacy Controls

Web browsers and devices may offer privacy controls, including cookie controls or signals indicating certain privacy preferences.

Voxutel will process legally recognized privacy preference signals where required by applicable law.

Other browser "Do Not Track" signals may not be recognized where no applicable legal requirement governs such signals.

18. Changes to This Privacy Policy

Voxutel may update this Privacy Policy from time to time to reflect changes in:

  • our Services;
  • technology;
  • business operations;
  • legal requirements; or
  • privacy practices.

The updated Privacy Policy will be posted with a revised "Last Updated" date.

Material changes may also be communicated through the Voxutel website, Customer portal, email, or another reasonable method where appropriate.
